Cancellation Policy
Details pursuant to Section 3 of the Distance Selling Act:
Consumers are entitled to a right of withdrawal according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities:
Right of Withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day,
- on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, if you have ordered one or more goods as part of a single order and the goods are delivered uniformly;
- or on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods, if you have ordered several goods as part of a single order and the goods are delivered separately;
- or on which you or a third party designated by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, if you have ordered goods that are delivered in several partial shipments or pieces.
If several of the above alternatives apply, the withdrawal period begins only on the day on which you or a third party named by you, who is not the carrier, took possession of the last goods or the last partial shipment or the last piece.
To exercise your right of withdrawal, you must inform us (ScaleMonkey / Karsten Möbius, Käthe-Kollwitz-Weg 73, 89081 Ulm, Germany, Phone: +49 (0)731 / 40390785, E-Mail: [email protected]) by means of a clear statement (e.g., a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.
You can also electronically fill out and submit the sample withdrawal form or any other clear statement on our website at Withdrawal Form. If you make use of this option, we will immediately send you (e.g., by e-mail) a confirmation of receipt of such a withdrawal.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must send back or hand over the goods to us, ScaleMonkey / Karsten Möbius, Käthe-Kollwitz-Weg 73, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.
Returns/packages sent freight collect will generally not be accepted!
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts
- for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
- for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded.
Premature Expiration of the Right of Withdrawal
The right of withdrawal expires prematurely for contracts
- for the supply of goods if, after delivery, they have been inseparably mixed with other goods due to their nature;
- for the supply of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
